Subletting in Dubai: the 2026 Law Made It Illegal

You rent a room in a two-bedroom in Marina, you transfer the money by card to another tenant, and there is no paperwork at all. As of late August 2026 that deal is void: only the owner, or a company the owner has authorised, may rent out a room. Below: who gets fined, who gets evicted, and what happens to the money you have already paid up front.

Two commencement dates, both from official mouths

This is a genuine discrepancy and there is no point hiding it.

Dubai Municipality and Gulf News say the law was published in the Official Gazette on 27 February 2026; add 180 days and you get a start date of 26 August 2026.

Law firms count differently: publication on 12 March 2026, issue No. 764, so the 180 days under Article 40 land on 8 September 2026.

Thirteen days apart. If your deal sits on the edge of those dates, work to the earlier one: 26 August. A lawyer can confirm the exact date for your contract from the Gazette text.

Who may now rent out a room

The list is closed and short:

  1. The owner of the flat or house.
  2. A licensed management company authorised by the owner.
  3. A company that leased the property from the owner specifically for shared housing and obtained a permit.

An ordinary tenant is out of that chain. He cannot re-let a room, a partitioned corner or a bed space, even with the flat owner's verbal agreement.

"The landlord doesn't mind" cures nothing. You need a Dubai Municipality permit and a registered contract; without both there is no deal.

What happens to your contract if a tenant rented you the room

That contract is void. Not "challengeable", not "risky" — it has no legal force from the outset.

For you that means this. You are not a legal occupant, you have no Ejari, no protection from eviction, and no contractual basis to claim anything in court. How ordinary tenancy works and why the paperwork decides everything is in our guide to tenant rights in Dubai.

The law separately bars an occupant from taking someone in or re-letting his own space (Article 26). Let a friend share for half the rent, and you are the one breaking the law.

The Dubai Municipality permit and the DLD register

Without a permit a unit cannot be designated for shared housing at all.

  • The permit is issued by Dubai Municipality together with the Dubai Land Department, valid for 1 year.
  • On request it can run for 2 years.
  • Renewal must be filed at least 30 days before expiry.
  • The unit is inspected against technical requirements: occupant limits, minimum floor area per person, building standards.

The DLD maintains an electronic shared-housing register linked to the Municipality platform. It also holds standard contract forms, the mandatory data set, and a separate rental index for shared housing. Flats, houses, townhouses, residential complexes, mixed-use and multi-storey buildings can all fall under shared housing. Labour accommodation is outside the law's scope.

The law sorts occupants into six categories: families, women, men, female students, male students, and employees of government bodies and private companies.

Money: monthly in advance, utilities, and refunds

Rent is payable monthly and in advance by default — Article 19. A different schedule is allowed, but it has to be written into the contract.

Electricity and water are included in the rent unless the parties agree otherwise in writing. The owner pays the utility providers, not you.

An occupant may move out early at any time on 30 days' written notice. On departure your advance payment is refunded, and no more than one month's rent may be withheld (Article 20(c)).

If the money is not returned within 30 days of your demand, go straight to the execution judge at the Rental Disputes Centre (Article 20(d)). Fines and what else the authorities can do

Money is not the only consequence.

  • A fine of AED 500 to AED 500,000 per violation.
  • A repeat within a year doubles it, to a maximum of AED 1 million.
  • Suspension of the business for up to 6 months.
  • Cancellation of the permit and withdrawal of the commercial licence.
  • Disconnection of utilities until the violation is remedied.
  • Eviction from a unit that does not meet the permit conditions.

What to do right now

If you rent a room. Ask who signs the contract — the owner, or another tenant like you. Ask to see the Dubai Municipality permit and the entry in the DLD register. Do not pay six months up front in cash: the law guarantees a refund only under a lawful contract.

If you sublet a room in the flat you rent. The scheme is closing. Give your occupants notice in advance and refund their money yourself — the execution judge will make it more expensive.

If you are an owner or an investor. You have one year from commencement to obtain permits, register contracts and bring the unit up to standard. The year runs from the law taking effect, not from today.

Can you sublet a room in a rented apartment in Dubai in 2026?

No. Under Dubai Law No. 4 of 2026 only the owner, or a company the owner has authorised holding a Dubai Municipality permit, may rent out a room or a bed space. A contract signed by a tenant is void. Verbal consent from the flat owner does not change that.

When exactly does Dubai's shared housing law take effect?

Will I be evicted if I rent a room under an informal agreement?

Not automatically, but you have no protection. The law allows eviction from units that fail the permit conditions, and disconnection of utilities until the violation is fixed. The fine falls on the person renting the space out, not the occupant. Your main risk is losing your advance payment and your housing with no compensation.

How do I get my money back if I move out of a room early?

Give the lessor 30 days' written notice. Your advance payment must be refunded, less no more than one month's rent (Article 20(c)). If it is not returned within 30 days of your demand, apply directly to the execution judge at the Rental Disputes Centre (Article 20(d)). This only works under a lawful contract made under the new law.
