The 30-90 day range and who sets the number

Your contract sets the number, not the law. Article 43 of Law No. 33/2021 gives only the corridor: no less than 30 days and no more than 90. The specific figure was agreed at hiring, and it often varies inside one company — 30 days for junior staff, 60 to 90 for management.

Notice must be given in writing. A verbal "I'm resigning" or a chat with HR does not start the clock.

The notice period is paid: salary and garden leave

An employer can keep you on the payroll and give you nothing to do. That is garden leave. Practice guidance says both gratuity and annual leave keep accruing through it: you are not in the office, but you stay on the company's books until the term ends. Buying out the notice: payment in lieu

Yes, and it works both ways. Article 43(3) of Law No. 33/2021 allows the contract to be closed immediately: the side that does not want to wait pays the other the salary for the unserved remainder. Analyses of this provision say the sum is calculated on the last actual salary rather than the basic rate alone — so more goes into it than into gratuity.

Step by step:

  1. One side states that it wants to end the notice period early.
  2. The parties count how many days or weeks of notice remain unserved.
  3. The initiating side pays that amount or deducts it from the final settlement.
  4. The contract ends as soon as the payment is made; nobody waits for the original date.

Employers buy out more often, when a role has to be freed up at once. But the employee can propose the same deal — for example, when a new employer wants a tight start date.

Leaving without serving notice: what follows

Simply stopping going to work is the worst option, because two mechanisms fire at once. This is the case where nothing was arranged: no full notice served, no written agreement to shorten it, and no payment in lieu.

The first mechanism is money. The side that neither served nor paid for the notice compensates the other with the salary for the missed period. That is the same payment in lieu, only now as the result of a unilateral break rather than a deal. The employer can deduct it from the final settlement.

The second is heavier. Under Article 8 of Ministerial Resolution No. 47/2022, an employee who resigned without the required notice and stopped coming to work during the notice period faces a one-year ban on a new work permit. Notice on probation

On probation (usually 3-6 months) the periods are shorter and do not match the 30-90 day range, which applies to confirmed employees.

How notice connects to your visa and a new employer

The notice period and visa cancellation are two separate clocks. The employer applies to cancel the work permit and residence visa only after the notice period has been served or bought out. Sources give different deadlines for that filing, so confirm the date with MOHRE and your employer.

  • Leaving on a verbal deal with your manager. Only written correspondence protects you from an argument over the start date and a compensation claim.
  • Not settling the transition terms in advance. If the new contract starts before your notice ends, calculate the payment in lieu first, not afterwards.
