UAE labour law 2026: worker rights from hiring to final gratuity

Key points
- One law covers private-sector employment — Federal Decree-Law No. 33/2021 — and MOHRE handles disputes. DIFC and ADGM are carved out, with their own laws, courts, and no MOHRE role.
- Since 1 June 2026, salaries must arrive through WPS by the 1st of the next month. The old 15-day grace window is gone.
- A MOHRE complaint buys up to 14 days of mediation. The ministry decides claims up to AED 50,000 itself and pushes anything larger to court.
- Gratuity follows Article 51 of Law No. 33/2021: 21 days' basic salary for each of the first 5 years, then 30 days a year after that, capped at two years' total salary.
- You get 2 years from your last day to file a labour claim (Federal Decree-Law No. 9/2024, in force since 31 August 2024).
Private-sector work in the UAE runs on one law — Federal Decree-Law No. 33/2021 — and one dispute body, MOHRE (Ministry of Human Resources and Emiratisation), where you must file a complaint before any court will hear you. DIFC and ADGM sit outside this: they run their own employment laws and courts, and MOHRE has no say there. Almost everything that matters — salary, dismissal, gratuity — comes with a deadline or an amount fixed in the law, not left to your employer's mood.
Your contract, leave and hours: the numbers fixed before any dispute
Contract type, leave entitlement and registration are settled long before anyone argues — and they decide what you can claim later.
- Limited vs unlimited contract in the UAE: what early exit costs — read before signing or resigning early: every contract is fixed-term now, and the compensation formula runs both ways.
- Annual leave and sick leave in the UAE: your days and your pay — read for the figures: 30 days of annual leave, the 15/30/45 sick pay split, and what unused days are worth at the end.
- Working without a contract in the UAE: what you are risking — read if you were told "start now, paperwork later": the fines on both sides, and how to prove employment from WhatsApp and bank transfers.
Unpaid salary: how to document it, complain, and know your rights
Late or missing salary starts with documentation and the MOHRE complaint channels — sort those before you talk to HR.
- Unpaid salary in the UAE: what to do step by step — start here if your pay is already overdue: how to document it, WPS deadlines, and your right to resign without losing entitlements.
- MOHRE complaint 2026: where to file and how long it takes — read once you've decided to complain: channels (app, website, phone, WhatsApp), mediation timelines, and how to check your case status.
Dismissal: rights, deadlines, and when it's actually illegal
Whether you quit or were let go, this is what your employer must pay and when a dismissal counts as unlawful in court.
- Fired in the UAE: rights, deadlines, and every payment owed — read right after termination: notice period, full settlement within 14 days, flight home, visa grace period.
- Unlawful dismissal in the UAE: compensation up to 3 months' salary — read if you were dismissed right after filing a MOHRE complaint or a claim against your employer — that's a separate ground for compensation under Article 47.
- Notice period in the UAE: 30 to 90 days — read the moment you decide to leave: who sets the number, whether it is paid, and how to buy it out.
- Resigning in the UAE: what you lose and what you keep — read before you hand in the letter: gratuity survives a resignation, and the visa clock does not start on your last working day.
- Labour ban in the UAE: the one-year rule explained — read if someone threatened you with a ban: what it actually blocks, who is exempt, and why it is not a travel ban.
Gratuity: what you're owed when you leave
End-of-service gratuity is its own payment, separate from salary and any unlawful-dismissal compensation, with its own formula and its own cap.
- UAE gratuity: how the legal formula works — read to understand the 21/30-day formula itself, what counts as basic salary, and when gratuity can legally be reduced.
- UAE gratuity calculator — get your number in a minute — read once the formula makes sense and you want the actual figure for your salary and years of service.
If your situation spans the whole dispute
When the problem crosses topics — unpaid salary tangled up with an open question about court and gratuity — one combined walkthrough beats several narrow guides.
- Labour dispute in the UAE: unpaid salary, MOHRE, gratuity — read if you want one compact walkthrough covering every step, from the MOHRE complaint through court to the gratuity calculation.
- Labour court in the UAE: from MOHRE to judgment — read once mediation has failed: the 14-day deadlines, the AED 50,000 threshold, who pays the court fee, and what gets awarded.
- Maternity leave in the UAE: 60 days and your pay — read if you are pregnant: 60 days of leave, 5 days for the second parent, paid nursing breaks, and protection from dismissal.
FAQ
Which law governs labour rights in the UAE?
Federal Decree-Law No. 33/2021 on the Regulation of Labour Relations, covering the private sector on the mainland and in most free zones. DIFC and ADGM are the exception: they run their own employment laws and courts, and MOHRE isn't a party there.
Where do I complain if my employer breaks the rules?
MOHRE — through its app, mohre.gov.ae, a phone call, or WhatsApp. The ministry allows up to 14 days for mediation, decides claims up to AED 50,000 itself, and refers larger ones to court.
What must an employer pay when you're terminated?
Salary for time worked, compensation for unused leave, gratuity, and usually a flight home — all within 14 days of your last working day. If the firing was payback for a MOHRE complaint or a lawsuit, Article 47 compensation (up to 3 months' salary) stacks on top.
How do I quickly work out my gratuity?
Apply the formula: 21 days' basic salary for each of the first 5 years of service, then 30 days a year after that, capped at two years' total salary. For the exact figure based on your own numbers, use the gratuity calculator linked above.
